Trillium Software, a division of Harte-Hanks, provides on its web site one or more weblogs (“Blogs”) for exchange of information and opinions. The following are the terms of use of the Blogs (“Blogging Terms”).
By accessing or viewing our Blog, contributing any content, or participating in communication on the Site in any way, you agree to these Blogging Terms. These Blogging Terms are subject to the Terms of Use and the policies that apply for the Trillium Software web Site generally. Please read these Blogging Terms, applicable policies, and the Terms of Use carefully. If you do not want to be subject to any of these terms and conditions, do not read, use, or contribute to our Blogs.
Trillium Software ContributionsTrillium Software may contribute content (each a “Trillium Software Contribution”). Trillium Software Contributions belong to Trillium Software and are subject to Trillium Software’s copyright ownership. You are permitted to access Trillium Software Contributions through the Internet. You can save, display, and print a copy of Trillium Software Contributions for your own internal business or personal use only. You may not otherwise copy, transmit, publish, distribute, display or in any way exploit any Trillium Software Contributions.
If any Trillium Software Contribution is provided by a named employee or agent of Trillium Software, then, unless otherwise expressly stated, the statements and opinions expressed in such Trillium Software Contribution are those of the author only and are not the statement or opinions of Trillium Software or its management.
User Registration Required For ContributorsTrillium Software requires users who wish to contribute to the Community (each a “Contributor”) to register with the Community. You may register to be a Contributor by choosing a username and password. You are not required to provide your true name or any identifying information. However you may not choose a username that is misleading or that misidentifies you as another person. Your username may not be indecent or offensive. Registration is not required to access and read the content of the Blogs.
Trillium Software reserves the right to remove user registration for any person for any reason.
User ContributionsBy posting content to any Blog (each a “User Contribution”), you grant Trillium Software a non-exclusive, royalty-free, perpetual, and worldwide license to such User Contribution. This license includes the right for Trillium Software to post the User Contribution in any Blog and to copy, archive, distribute, transmit, display, edit, translate, quote from, excerpt, and reformat any User Contribution, and to incorporate it into any collective work, database or archive.
You agree not to provide any User Contribution that is illegal, misleading, defamatory, indecent or obscene, in poor taste, threatening, infringing of any third party proprietary rights, disrespectful, invasive of personal privacy, or otherwise objectionable. By posting any User Contribution, you represent that you have all required rights and permissions to do so.
You are not required to include any information in any Contribution that identifies you. If you chose to include personal identifying information, you do so at your own risk.
Trillium Software reserves the right not to post or to remove any User Contribution from any Blog for any reason. Trillium Software may, but is not required to, screen content before posting or use. Trillium Software may limit the length of User Contributions.
Non-Commercial UseThe Blogs are for noncommercial use only. You agree not to provide any Contribution that includes a request for money or contains any promotion, advertising, or any solicitation involving goods or services. You agree not to solicit other users of Blogs to join any organization or enterprise. You will not solicit or collect personal data about Contributors or other users. You may not claim that Trillium Software endorses you, your activities, your business, or your User Contributions.
Third-Party Sites and LinksLinks to third party Internet sites may be in Trillium Software Contributions and in User Contributions. Trillium Software does not approve or endorse the contents of any third party site or data that may be reached by means of any link. Trillium Software has no control over such third party sites, and Trillium Software is not responsible for any content on such sites or their privacy policies and practices.
No Guarantee Regarding Trillium Software Contributions or User Contributions
Trillium Software assumes no responsibility for the accuracy, completeness, or usefulness of information in any material in any Blog, including any Trillium Software Contributions and any User Contributions. Trillium Software does not approve or endorse any statements, opinions or recommendations in Trillium Software Contributions and any User Contributions.
While there may be discussion of technology or solutions in any Blog, you employ or use any technology or solution at your own risk. There is no representation or warranty that any technology or solution discussed in any Trillium Software Contribution or any User Contribution will function or provide any particular result. It is up to you to determine whether any licenses, consents, permissions, or purchases of goods or services may be required to make, copy, use, or sell any technology or solution.
Trillium Software grants no license to any user of any Blog under any patent, trademark, trade secret, copyright or any other intellectual property right, except for the permissions to view and print Trillium Software Contributions as expressly stated above.
Blogs are not provided for Trillium Software technical support. You agree not to make support requests though any Blog.
No Robots and SpidersUse of Blogs is for participants and readers only. You agree not use any automated means, including, without limitation, agents, robots, scripts, or spiders, to access, monitor or copy any part of any Blog. This provision does not prevent you form using any RSS feeds provided in the Trillium Software web Site. Blogs may be indexed by search engines that survey the Web and are available to the public generally.
IndemnificationYou agree to indemnify, defend and hold harmless Trillium Software, its affiliates and subsidiaries, and their officers, directors, owners, employees, and agents from and against any and all liability, losses, costs and expenses (including attorneys' fees) incurred by any of them in connection with any claim arising out of any User Contribution that you provide, your violation of these Blogging Terms, or your violation of the policies and Terms of Use that apply for the Trillium Software web Site generally.
THE WEBLOGS AND THEIR CONTENTS ARE PROVIDED "AS IS." TRILLIUM SOFTWARE MAKES NO WARRANTIES OF ANY KIND. INACCURACIES OR MISTAKES ARE POSSIBLE. TRILLIUM SOFTWARE DOES NOT WARRANT THAT THE COMMUNITY WEBLOGS AND THEIR CONTENT WILL MEET YOUR REQUIREMENTS OR WILL BE UNINTERRUPTED OR ERROR FREE. TRILLIUM SOFTWARE EXPRESSLY EXCLUDES AND DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF ANY THIRD PARTY INTELLECTUAL PROPERTY RIGHTS. TRILLIUM SOFTWARE SHALL NOT BE RESPONSIBLE FOR ANY DAMAGE OR LOSS OF ANY KIND ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBLOGS OR THEIR CONTENT.
Limitation of LiabilityIN NO EVENT SHALL TRILLIUM SOFTWARE OR ITS SUBSIDIARIES BE LIABLE FOR ANY SPECIAL, INCIDENTAL, PUNITIVE, MULTIPLE, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, EVEN IF TRILLIUM SOFTWARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Compliance with LawYou agree that your use of any Blog will comply with all applicable laws, rules and regulations.
Changes to Terms of UseTrillium Software reserves the right to make changes to these Blogging Terms at any time. Your continued access to, viewing, contributions to, or other use of any Blog will constitute your acceptance of any new terms and conditions.
